Can we take your claim?

We help West Virginians with Social Security disability and VA claims, at no charge. For Social Security claims, your household’s income has to be at or under twice the federal poverty guideline; we’ll work it out with you on the first call. Veterans’ claims have no income test.

We can’t take every claim, because there are three of us. If we can’t take yours, we say so in the first week and give you the names of other offices that might.

  • You live in West Virginia

  • Your claim is with Social Security or the VA

  • Income limits apply to Social Security claims only

Four kinds of claims

Which claim is yours?

Each page says who the program is for and where claims in it tend to stall.

  • SSDI

You worked and paid Social Security tax, and a condition now keeps you from working.

  • SSI

You have little income and few savings, and you’re disabled, or you’re caring for a disabled child.

    About SSI claims
  • VA claims

You served, and a condition that began or worsened in service is rated too low, or not at all.

    About VA claims
  • Hearings and appeals

You’ve been denied, or rated, and you want someone to look again.

What we send elsewhere

These are real problems, just not ours to handle. We’ll point you to someone who does them.

  • Workers’ compensation

Injuries on the job go through the state’s workers’ compensation system and a lawyer who practices there.

  • Private disability insurance

A long-term disability policy from an employer is a contract claim, not a government benefit.

  • Black lung benefits

Coal miners’ claims go to the Department of Labor. We’ll give you the names of offices that take them.

Can’t tell which claim it is?

Call and describe the letter. We’ll tell you which claim it is, and whether we can help.
