Questions
Before you pick up the phone
Is it really free?
Yes. We don’t charge a fee, and we don’t take part of your back pay. The clinic pays for records and copies too, so you won’t owe costs either.
How do private lawyers charge for these claims?
For Social Security, the fee is set by law: a share of back pay, capped, approved by the agency and paid from your back pay. For VA claims, accredited lawyers can charge a share of past-due benefits after a first decision. We charge neither.
Do I need a lawyer to apply?
No. Many people apply on their own. A lawyer helps most when a claim is denied, when the records are scattered, or when a hearing is coming.
How long does a claim take?
A first Social Security decision takes several months. A hearing can be a year or more after that. VA claims vary widely. We’ll give you an honest guess for yours.
Can I keep my own doctor?
Yes, and we’d like you to. Opinions from doctors who treat you over time carry weight with both agencies.
What if I’ve missed a deadline?
Call anyway. Both agencies accept late appeals for good reasons, like illness or a letter sent to the wrong address.
Do I have to come to Charleston?
No. We meet by phone, and in person at libraries in several counties when that’s easier.
Will you take a claim another lawyer dropped?
Often, yes. Ask the other lawyer to send us the file, and tell us why they stepped away.
Something we didn’t cover?
Call or write. The first conversation is free and confidential.
